1. Professional Engineering License & Responsibility

Qualified User Requirement

The Service is strictly limited to use by qualified electrical engineers or professionals with equivalent technical training. You represent and warrant that you possess the necessary expertise to evaluate the output of the Service.

Engineering Tool Status

You acknowledge that the Service is a calculation aid and not a professional engineering service. The results are simulations based on mathematical models derived from published engineering standards.

Final Engineering Seal

You acknowledge that results, reports, and labels generated by the Service must be reviewed, verified, and sealed by a licensed Professional Engineer (PE) or a competent authority before implementation in any physical electrical installation.

Input Accuracy (GIGO Principle)

The "Garbage In, Garbage Out" (GIGO) principle applies. NormaLang Studio is not responsible for errors resulting from incorrect equipment parameters, conductor lengths, impedance data, or protective device settings provided by the User.

2. Warranty Disclaimer ("AS IS")

Standards Evolution

We do not warrant that results will remain valid if engineering standards (e.g., IEEE 1584, IEC 60909, NFPA 70E) are updated or modified after the calculation is performed.

Specific Purpose

We disclaim all warranties, including the implied warranties of Merchantability and Fitness for a Particular Purpose. We do not warrant that the Service will meet your specific project requirements or that the results will be 100% accurate under all possible field conditions.

3. Limitation of Liability

In no event shall NormaLang Studio's total liability to you for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) exceed the total amount paid by you to NormaLang Studio for the Service during the twelve (12) months immediately preceding the event giving rise to the liability. This limitation is cumulative and not per incident.

Exclusion of Consequential Damages

In no event shall NormaLang Studio be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

4. Indemnification & Third-Party Reliance

No Third-Party Beneficiaries

This Service is for your internal use only. If you provide reports generated by the Service to a client or third party, you do so at your own risk. NormaLang Studio owes no duty of care to any third party who relies on reports generated by the User.

Indemnity

You agree to indemnify, defend and hold NormaLang Studio harmless from any third-party claims, lawsuits, or damages (including personal injury or property damage) arising from the application of studies, TCC settings, or Arc Flash labels generated by the Service, even if such claims allege negligence by NormaLang Studio.

5. Intellectual Property & Reverse Engineering

Algorithm Protection

You shall not, and shall not permit any third party to reverse engineer, decompile, or attempt to extract the source code or mathematical algorithms of our proprietary calculation engines.

Database Protection

The device library and TCC curve equations are proprietary data. Automated extraction ("scraping") is strictly prohibited.

6. Subscription, Account & Usage

Account Integrity

Accounts are for named-user use. Sharing credentials across different physical persons is strictly prohibited.

Audit Rights

We reserve the right to monitor usage patterns and IP access. Excessive simultaneous logins or geographical anomalies may result in automatic account suspension for security verification.

Account Termination

Upon termination of your subscription, you will have 30 days to export your data. After this period, your data may be permanently deleted from our systems. We reserve the right to terminate accounts that violate these Terms.

Refund Policy

Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.

7. Third-Party Services

The Service integrates with third-party services for authentication (Clerk), payment processing (Stripe), and cloud infrastructure. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or performance of third-party services.

8. Regulatory Compliance & Force Majeure

Regulatory Compliance

While NormaLang Studio assists in compliance with NFPA 70E, OSHA, and other electrical safety standards, the User is solely responsible for final safety implementation and regulatory compliance.

Force Majeure

NormaLang Studio is not liable for failures due to causes beyond its control, including but not limited to cloud infrastructure outages, cyber-attacks, natural disasters, pandemics, or government actions.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Toronto, Ontario, rather than in court, except that either party may seek injunctive relief in court for intellectual property violations.

For claims under CAD $10,000, disputes may alternatively be resolved in small claims court.
